1. Introduction

These terms govern your use of the Breen Tree Surgery Ltd website (breentree-surgery.co.uk) and any services provided by Breen Tree Surgery Ltd. By using this website, you accept these terms in full.

2. Services

Breen Tree Surgery Ltd provides tree surgery and arborist services including, but not limited to: tree removal, pruning, crown reduction, stump grinding, hedge maintenance, and emergency tree work. All services are subject to a site visit and written quotation prior to commencement of work.

3. Quotations

All quotations are provided in writing following a site assessment. Quotations are valid for 30 days from the date of issue unless otherwise stated. Acceptance of a quotation constitutes agreement to proceed on the terms set out therein.

4. Client Responsibilities

The client is responsible for:

  • Ensuring we have adequate access to the site and the trees in question
  • Notifying us of any underground services, utilities, or obstructions that may affect the work
  • Obtaining any necessary permissions (including planning permissions or Tree Preservation Order consents) prior to work commencing
  • Ensuring the site is safe and accessible on the agreed day of work

5. Our Responsibilities

Breen Tree Surgery Ltd will carry out all agreed works operating in line with industry best practices and aligned with site and safety requirements. We will carry out work safely, professionally, and to the specification agreed in the quotation.

6. Cancellation

Either party may cancel or postpone work with reasonable notice. Where work is cancelled by the client after mobilisation has occurred, reasonable costs may be charged. We will notify you as early as possible of any changes to scheduled dates on our part.

7. Payment

Payment terms will be set out in the written quotation. We reserve the right to charge reasonable interest on overdue invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 where applicable.

8. Liability

We maintain appropriate public liability insurance. Our liability is limited to the value of the contract in question except in cases of personal injury or death caused by our negligence.

We are not liable for damage caused by pre-existing defects or conditions in trees, ground, or structures that were not disclosed or reasonably identifiable at the time of quotation.

9. Website Use

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
